Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and TruHunt L.L.C. ("TruHunt," "we," "us," or "our") governing your access to and use of TruHunt's mobile applications, websites, map layers, features, content, and related products and services (collectively, the "Service").

By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

§1Acceptance of Terms

By clicking "I Agree," creating an account, purchasing a subscription, downloading the app, or otherwise accessing or using the Service, you agree to be bound by these Terms, including any future updates we post.

IMPORTANT: These Terms include binding arbitration and a class action waiver (see Section 18).

§2Eligibility

You represent that you are at least 18 years old (or the age of majority in your jurisdiction), able to form a binding contract, and not barred from using the Service under applicable law.

§3Privacy

Your use of the Service is also subject to our Privacy Policy. You acknowledge we may collect and use information as described in the Privacy Policy.

§4Changes to the Service and Terms

We may modify, suspend, or discontinue any part of the Service at any time. We may also update these Terms. If we make material changes, we may provide notice within the app, on our website, or by other reasonable means. Your continued use after changes become effective constitutes acceptance.

§5License Grant; Ownership

5.1 License. Subject to your compliance with these Terms, TruHunt grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your personal, non-commercial use.

5.2 Ownership. Except for User Content (defined below), TruHunt and its licensors own all right, title, and interest in and to the Service, including maps, layers, data compilations, software, designs, and trademarks.

5.3 Restrictions. You may not: copy, sell, rent, sublicense, distribute, or commercially exploit the Service; reverse engineer or attempt to derive source code except where prohibited by law; scrape, crawl, or use automated tools to extract data at scale; remove proprietary notices; or use the Service to build a competing product or dataset.

§6Accounts and Security

Some features require an account. You agree to provide accurate information and keep it updated. You are responsible for all activity under your account and for maintaining the confidentiality of your credentials. We may suspend or terminate accounts for inaccurate information or security concerns.

§7Subscriptions, Billing, and Cancellation

7.1 App Store purchases. If you purchase a subscription through Apple's App Store or Google Play, billing, renewals, and cancellations are handled by the applicable App Store, not TruHunt.

7.2 Auto-renewal. Subscriptions may automatically renew unless you cancel through the App Store settings at least 24 hours before renewal.

7.3 No refunds from TruHunt for App Store purchases. Refunds (if any) are governed by the App Store's policies.

7.4 Changes in pricing/features. We may change subscription pricing or features to the extent permitted by law and App Store rules, and we may provide notice as required.

§8Georgia DNR Data Disclosure

Certain Georgia hunting-related data made available through the Service may be sourced from the Georgia Department of Natural Resources (Georgia DNR). TruHunt does not warrant, guarantee, or independently verify the accuracy, completeness, timeliness, or legal sufficiency of such data. Regulatory, boundary, and season information is only as accurate as the official data published by Georgia DNR. You are responsible for confirming all hunting regulations and boundaries directly with Georgia DNR before hunting.

§9Outdoors Safety; Assumption of Risk

Outdoor activities (including hunting, navigation, and firearm use) involve inherent risks that may result in property damage, injury, or death. You assume all risks related to your use of the Service and your outdoor activities.

You are responsible for: obeying all laws and regulations (hunting, trespass, weapons, vehicle access, etc.); verifying boundaries, access permissions, and conditions on the ground; and using common sense and proper safety practices.

§10User Content

"User Content" means content you submit or upload (e.g., waypoints, notes, photos, reviews, shared locations, messages).

10.1 Your ownership. You retain ownership of your User Content.

10.2 License to TruHunt. You grant TruHunt a worldwide, royalty-free, sublicensable license to host, store, reproduce, display, and otherwise use your User Content solely to operate, improve, and provide the Service.

10.3 Responsibility. You are responsible for your User Content and represent you have all necessary rights to submit it, and that it does not violate law or third-party rights.

§11Prohibited Conduct

You agree not to: post unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, or hateful content; impersonate others or misrepresent affiliation; upload malware or attempt to disrupt the Service; violate any third-party rights (privacy, copyright, trademark, etc.); use the Service for unlawful purposes; or interfere with others' use of the Service.

§12Third-Party Services and Links

The Service may include links to third-party services (including land data providers, imagery, payment platforms, or other tools). We do not control and are not responsible for third-party services, and your use of them is subject to their terms.

§13Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee the accuracy of maps, GPS data, land boundaries, wildlife information, government-sourced datasets, or other content.

§14Limitation of Liability

To the maximum extent permitted by law, TruHunt is not liable for indirect, incidental, consequential, special, exemplary, or punitive damages. TruHunt's total liability will not exceed $100 or the amount you paid in the past 12 months, whichever is greater.

§15Indemnification

You agree to indemnify and hold harmless TruHunt L.L.C. from claims arising out of your use of the Service, your User Content, or your violation of these Terms or applicable law.

§16Termination

We may suspend or terminate your access if you violate these Terms or if we reasonably believe your use poses risk to the Service, users, or third parties.

§17Governing Law

These Terms are governed by the laws of the State of Georgia, excluding conflict-of-law rules.

§18Binding Arbitration; Class Action Waiver

All disputes will be resolved by binding arbitration in Georgia, and you waive any right to a jury trial and to participate in class actions or class arbitration.

§19Copyright Complaints (DMCA)
